Did you know that the City of Gillette has a Code Compliance Program that deals with nuisance complaints and issues such as tall weeds and grass? This program operates year-round and has been very successful in keeping with the City’s beautification plan.
The City of Gillette continually strives to make the City a great place to live, and the Code Compliance Program plays an integral part in that. However, citizen involvement and cooperation is also necessary for the program to be successful.
If your question(s) is not addressed below and/or you wish to file a complaint, please call the Code Compliance Inspector at 686-5309.
(Q) How does this program work?
(A) A person can call in a complaint at any time regarding items they feel are in violation of Chapter 13 [PDF] of the City Code. The Code Compliance Inspector will verify the complaint by a personal visit to the location and a letter will be sent to the property owner asking for compliance. If compliance is received, the property owner is sent a thank you letter for complying. If compliance isn’t received within the allotted timeframe, the violator receives a citation and a mandatory appearance in court with the judge issuing the penalty or an abatement of the property occurs.
(Q) What are the penalties for non-compliance?
(A) The judge can issue up to a $750 fine (to which may be added court costs) for each offense. Each day’s non-compliance shall constitute a separate offense.
(Q) What is the definition of a nuisance?
(A) The creation and/or maintenance by any person of any condition or use of real or personal property in such a manner as to offend the sense or to unreasonably interfere with the use or enjoyment of the property of another or which is detrimental to the property of another or which causes the substantial diminution in or degrades the value of another’s property by permitting any condition to exist which results in substantial annoyance, inconvenience or injury to the public, in whole or part.
(Q) Can I have inoperable/unlicensed vehicle(s) or wrecked/junked vehicles and/or automobile parts on my property?
(A) You cannot have these items on your property for more than 14 days unless they are properly stored in an enclosed building or in a properly zoned area.
(Q) What is the definition of an antique vehicle?
(A) Any motor vehicle that is at least 25 years old and owned solely as a collector’s item and licensed pursuant to Wyoming Statutes, Section 31-3-102.
(Q) Are there any exceptions for an antique or historic vehicle with regards to license plates?
(A) The City follows the Wyoming Statutes 1977, Sections 31-3-102 which lists the cost of the vehicle’s plates.
(Q) How long can I leave my stove, refrigerator, washing machine or other appliance outside without being in violation of the City Code?
(A) You cannot leave these items outside for more than 24 hours. These items are deemed a danger and constitute a public life safety hazard.
(Q) How tall can grass be before I am in violation of the City Code?
(A) Twelve (12) inches and higher are considered a nuisance.
(Q) Can tires, buckets, bottles, etc. be stored outside?
(A) These items cannot be stored outside for longer than 72 hours and even then must be stored in such a manner that prevents the collection and stagnation of water.
(Q) Are there any requirements for storage of construction debris?
(A) All construction debris and litter must be controlled on site to prevent wind blown debris from impacting adjacent properties. The owner, responsible person or contractor shall have and maintain on the site a proper container to contain or otherwise control construction debris generated on the site.
